Places Of Amusement
The Saint James Parish Council is intensifying
efforts to inform business operators and the general populace about
the Places of Amusement Act. This
Act requires that all persons operating a cinema,
dance hall, club, open air dance venue, amusement arcade, any place
where a coin-operated amusement machine is open to the public, a
festival, discotheque, roller disco, or skate ring must apply to
the Council for a licence.
The purpose of the licence is to protect the
public by ensuring all safety and fire regulations are adhered to.

THE PARISH COUNCILS ACT
THE SAINT JAMES PARISH COUNCIL (PLACES OF AMUSEMENT)
REGULATIONS, 1999
In
exercise of the powers conferred by section 121 of the Parish
Councils Act and of every other power hereunto enabling, the
following Regulations by the Parish Council for the parish of Saint
James are hereby made with the approval of the Minister:--
- These
Regulations may be cited as the Saint James Parish Council
(Places of Amusement) Regulations, 1999.
- In
these regulations—
“authorized
person” means a person authorized by Council to carry out any
function in relation to the enforcement or application of these
Regulations;
“cinema”
means any place where cinematograph exhibitions are held;
“Council”
means the Parish Council for the parish of Saint James;
“Fire
Commissioner” means the Commissioner of the Jamaica Fire Brigade;
“licence”
means a licence granted under these Regulations;
“licensee”
means the holder of a licence under these Regulations;
“place
of amusement” means any place open to the public, whether for a
fee or free of charge, for the purpose of entertainment
and, without limit to the generality of the foregoing, includes a
cinema, dance hall, club, open air dance venue, amusement
arcade,
any place where a coin-operated amusement machine is open to the
public, a festival, discotheque, roller disco, or skate ring;
“prescribed
requirements” means the requirements prescribed in these
Regulations, for the grant of a licence.

3.—
(1) No
person shall operate a place of amusement in the parish of
Saint James, other than under the provisions of a licence
granted to that person in respect of the place of amusement |

(2)
A person requiring a licence shall apply in writing to
the Secretary of the Council in the form set out in the First
Schedule and shall submit with such application--- |

(a)
the appropriate licence fee specified in the Second
Schedule;
(b)
proof of insurance, with a reputable insurance company,
in respect of public liability, fire and allied perils; and
where
the licence is in respect of a building, a certificate from
the Fire Commissioner confirming that satisfactory fire
precautions are in place.

The Council may grant exemption from payment of a
licence fee upon proof by the applicant that the amusement is
being held for the purpose of raising funds for the benefit of
the local community.
